Terms and Conditions

These Terms and Conditions govern the provision of services by Gaisford Greene. By engaging the services of Gaisford Greene, the client agrees to be bound by the following terms.

1. ROLE OF GAISFORD GREENE

1.1 Gaisford Greene provides bespoke travel planning and concierge services to clients.

1.2 In the course of providing these services, Gaisford Greene may design itineraries, make recommendations and arrange or coordinate services with third-party suppliers, including but not limited to accommodation providers, transport providers, restaurants, guides, activity providers and other experience or service providers.

1.3 Where a client elects to proceed with the services of Gaisford Greene, a planning fee will be charged in consideration of the time, expertise and work involved in preparing a tailored itinerary and related arrangements.

1.4 Unless expressly agreed otherwise in writing, Gaisford Greene acts solely as an intermediary in arranging services provided by third-party suppliers.

1.5 Any contract for accommodation, transport, dining, experiences or other services is entered into directly between the client and the relevant third-party supplier.

1.6 Gaisford Greene is not the provider of such services and shall not be a party to any contract between the client and the supplier.

2. PLANNING FEES

2.1 A planning fee shall be payable where a client elects to proceed with the services of Gaisford Greene following an initial consultation or discussion.

2.2 The planning fee is charged in consideration of the time, expertise and work involved in researching, designing and preparing a bespoke itinerary and coordinating potential arrangements on behalf of the client.

2.3 The amount of the planning fee will be confirmed to the client prior to the commencement of any detailed planning work.

2.4 The planning fee is non-refundable once paid, regardless of whether the client subsequently decides not to proceed with any proposed itinerary, bookings or arrangements.

2.5 Payment of the planning fee constitutes acceptance of these Terms and Conditions.

3. THIRD-PARTY SUPPLIERS

3.1 Gaisford Greene may recommend, introduce, arrange or coordinate services provided by third-party suppliers.

3.2 These suppliers may include, without limitation, accommodation providers, transport providers, restaurants, guides, activity providers and other experience or service providers.

3.3 Gaisford Greene generally works with a network of trusted suppliers with whom it has established professional relationships. Where appropriate or where requested by the client, Gaisford Greene may research and introduce additional suppliers.

3.4 Gaisford Greene will act as the principal point of contact between the client and any third-party suppliers in relation to arrangements made through its services.

3.5 All services provided by third-party suppliers are subject to the terms and conditions of the relevant supplier.

3.6 Clients are responsible for reviewing and complying with those terms and conditions.

3.7 Gaisford Greene shall not be responsible for the acts, omissions, performance or failure of any third-party supplier.

4. BOOKINGS AND PAYMENTS

4.1 Where a client authorises Gaisford Greene to proceed with a booking or arrangement, such authorisation may be provided by email.

4.2 Gaisford Greene will communicate payment requests or booking requirements received from suppliers to the client.

4.3 All payments for services arranged through third-party suppliers shall be made directly by the client to the relevant supplier unless otherwise agreed in writing.

4.4 Payment terms, including deposits or full payment requirements, will be determined by the relevant supplier.

4.5 A booking shall be considered confirmed only once payment has been successfully made to the supplier and confirmation has been received from the supplier.

4.6 Where a client fails to make payment within the timeframe required by the supplier, Gaisford Greene shall not be responsible for any resulting loss of availability or cancellation of services.

4.7 All cancellations, refunds and amendments relating to services provided by third-party suppliers remain subject to the supplier’s own terms and conditions.

5. CHANGES TO ITINERARIES

5.1 Clients may request reasonable adjustments or minor changes to proposed arrangements.

5.2 Gaisford Greene will endeavour to accommodate such requests where possible.

5.3 Where significant changes are requested, including additional destinations, extended travel periods or substantial revisions to agreed arrangements, Gaisford Greene reserves the right to charge additional planning or concierge fees.

5.4 Any such additional fees will be communicated to the client in advance where reasonably practicable.

5.5 Amendments to bookings arranged through third-party suppliers remain subject to the supplier’s terms and conditions.

6. LIMITATION OF LIABILITY

6.1 Gaisford Greene shall exercise reasonable care and skill in the provision of its services.

6.2 Gaisford Greene shall not be liable for the acts, omissions, performance or failure of any third-party supplier.

6.3 Gaisford Greene shall not be responsible for any loss, delay, inconvenience, additional expense or other indirect or consequential loss arising from services provided by third-party suppliers or circumstances outside its reasonable control.

6.4 Clients are strongly advised to obtain appropriate travel insurance.

6.5 To the fullest extent permitted by law, the total liability of Gaisford Greene shall not exceed the amount of the planning fee paid by the client.

6.6 Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or any liability which cannot be excluded by law.

7. FORCE MAJEURE

7.1 Gaisford Greene shall not be liable for any failure or delay in the performance of its obligations where such failure results from events beyond its reasonable control.

7.2 Such events may include, without limitation, natural disasters, severe weather, transport disruption, strikes, government restrictions, public health emergencies, acts of terrorism or civil unrest.

7.3 In such circumstances, Gaisford Greene will use reasonable efforts to assist the client in seeking alternative arrangements where practicable.

8. CLIENT RESPONSIBILITIES

8.1 Clients must provide accurate and complete information necessary for travel arrangements.

8.2 Gaisford Greene shall not be responsible for errors or losses resulting from inaccurate information provided by the client.

8.3 Clients are responsible for ensuring that they hold all required travel documentation including passports, visas and any other entry requirements.

8.4 Clients must comply with the rules and policies of any third-party supplier.

8.5 Gaisford Greene reserves the right to withdraw services where a client behaves unlawfully, abusively or inappropriately towards suppliers.

9. COMPLAINTS

9.1 If a client experiences any issue relating to arrangements made through Gaisford Greene, the client should notify Gaisford Greene as soon as reasonably possible.

9.2 Where the issue relates to services provided by a third-party supplier, the client should also notify the supplier at the time the issue arises.

9.3 Gaisford Greene will use reasonable efforts to assist in resolving the issue where possible.

10. PRIVACY

10.1 Gaisford Greene may collect and process personal data necessary to arrange travel and related services.

10.2 Personal information may be shared with relevant third-party suppliers where required to facilitate bookings.

10.3 All personal data will be handled in accordance with applicable data protection laws and Gaisford Greene’s Privacy Policy.

11. COMMUNICATIONS

11.1 Communication with Gaisford Greene may take place via email, telephone or messaging services such as WhatsApp.

11.2 Instructions or approvals provided through these communication channels may be relied upon by Gaisford Greene as authorisation to proceed with arrangements.

12. GOVERNING LAW

12.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

12.2 Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
